Rules of Membership

1. The Club

a)        Compass Health and Fitness (the club) is owned by Compass Health and Fitness Ltd. The club premises are located at Barry’s Lane Leisure Complex, Barry’s Lane, Scarborough, YO12 4HA or such other premises that the club may provide.  

2. Principle Terms

a)        The agreement of membership commences when a member signs the Physical Activity and Readiness Questionnaire and on the date signed.

b)        The member cannot transfer the agreement to any other person without prior permission of the management.

c)        Having purchased a membership at Compass Health and Fitness and the member does not attend for whatever reason, the member will not be entitled to a refund unless in exceptional circumstances and only at the discretion of the company. It should be noted that a member pays for the membership of the club regardless of the number of visits.

3. Limitations of Liability

a)        On agreement of membership the Member agrees that:

(1)      Neither the Company nor it’s employees or agents shall be liable for any loss, damage or theft of any property belonging to or brought onto the club premises by the Member, any guest of a Member or pay as you go Member.

(2)      Neither the Company nor any employees or agent of the Company shall be responsible for any death, personal injury or illness occurring upon the club premises or as a result of the use of the facilities and/or equipment provided by the club, except to the extent that such death, personal injury or illness arises from any negligent act or omission of the Company or its employee or agent.

4. Physical Conditions of Member

a)        The Member warrants and represents that they are in good physical condition and that they know of no medical or other reason why they are not capable of engaging in active or passive exercise and that such exercise would not be detrimental to their health, safety, comfort or physical condition of any other Member.

b)        The Member shall not use any Club facilities whilst suffering from any infections contagious illness, disease or other such ailment such as open cuts, abrasions, open sores where there is a risk that the condition may be detrimental to the health of other members.

c)        Before participation the Member must sight a Health Commitment Statement, copies of which are available from reception.

5. Memberships

a)        Memberships shall be divided into two categories: Full and Corporate

b)        All categories of membership shall be subject to these rules.

c)        All members shall be at least 14 years of age. All Members of the age 15 years and under shall be accompanied by an adult (over 18).

d)        Other memberships shall be on such terms as the Company may specify from time to time.

6. Fees and Charges

a)        Where the member elects to pay the annual fee to receive a discount, this shall be payable in advance and as per 2.c not entitled to a refund.

All monthly memberships fees whether ‘Full’ or ‘Corporate’ shall be paid by Standing Order or Direct Debit in advance. In the case of 

a)        Direct Debit memberships the membership is collected by ‘Ashbourne’ a third party company.

b)        A no contract membership carry no contract other than the remainder of the calendar month that has already been paid for.

c)        If a member with a No Contract membership wishes to terminate their membership they may do so without notice; the club would however appreciate a phone call or letter to forewarn of the termination. A member on a 12 month commitment membership must notify either the Club or Ashbourne to cancel the membership on completion of the 12 months.

d)        Where payment is made by Standing Order  the responsibility to cancel the Standing Order lies solely with the Member/Account holder to which the Standing Order is set up.  The club takes no responsibility under any circumstance if a member fails to cancel the Standing Order regardless of circumstance.

1. Opening Hours

a)        The Clubs normal hours of operation are displayed within the Club and a copy is available on request. Such hours may be lengthened or shortened at the absolute discretion of the Company with or without prior notice to Members being given. The Company will however endeavour to give reasonable notice to the lengthening or shortening of such hours.

2. Lockers

a)        All lockers throughout the facility are locked through the use of a padlock. Members may bring their own padlock or may purchase one form the Club.

b)        All lockers shall be vacated at the end of each Members visit. Lockers that remain locked upon closing will have the padlock removed and the contents stored in lost property for a period of one week. Following that period the property will be disposed of.

3. Group Exercise

a)        Classes may be booked from 0800 on a Saturday for the following week.

b)        Members are requested to advise the club if they are unable to attend a class.

c)        Late arrivals will be permitted into the class at the sole discretion of the instructor.

4. General

a)        No pets are allowed entry into the club with the exemption of Guide Dogs.

b)        Children are not allowed entry to the club other than to participate in a designated Children’s class or when accompanied by an adult for a club tour.  Children may visit with a parent if visiting other onsite facilities such as the Hair Salon and Beautician but must not be left unattended so that their accompanying adult can exercise.

c)        Whilst exercising members should wear suitable clean clothes and footwear. The Company reserves the right to ask a member to leave the gym floor should the club deem their clothing unsuitable (i.e.  jeans, dirty clothing or dirty shoes etc.)

d)        Personal Training may only take place with the sole permission of the company under prior contractual arrangement. Anyone deemed to be Personal Training for profit will have their membership terminated with immediate effect without claim for refund of membership charges.

e)        Training tops must be worn at all times whilst on the gym floor.

f)         All equipment once used should be returned to it’s correct stowage. Any member who is found to consistently leave their equipment lying around after having been told will be asked to leave the club and have their membership terminated.
